Sterling Lodge Rules & Regulations
Adopted by the Board of Trustees 5/2022
Section 13.3, 13.3.1 and 14.2 of the Sterling Lodge CCR’s, the Board of Trustees has the authority to create additional Restrictions on Use (see section 12 CCR) as they may deem necessary for the maintenance, safety, comfort and enjoyment of all Owners and their families, Guests or Residential Renters. The Rules and Regulations adopted by the Board are outlined below. The Board, as per section 12.1.12 of the CCR also has the authority to take any action for failure to abide by approved Rules and Regulations as outlined below. The Sterling Lodge property management company and its employees shall have full authority to enforce these Rules and Regulations.
Fines- fines may be imposed per Utah Code Title 57 Chapter 8 Section 37 for CCR or rules violations. Before assessing fines, the management committee or manager shall give notice to the unit owner of the violation and inform the owner that a fine will be imposed if the violation is not cured within 48 hours. Fines may be levied by the Association’s Board of Trustees in accordance with the following fine schedule:
First Notice of Violation: Written warning explaining violation and timeframe for remedy and correction.
Second Notice: If violation has not been remedied, a fine of $100.00 shall be imposed.
Third Notice: If violation continues, a fine of up to $500.00 per day may be imposed.
Rules & Regulations
- Parties- Parties of a disruptive nature are not allowed.
- No Owner and their families, Guests or Renters shall make or permit any noise that will disturb or annoy or do or permit anything to be done which will interfere with the comfort or convenience of the occupants of any other condominium.
- Quiet Time- The hours between 10 PM and 8 AM are designated as quiet time. Special care must be taken during these hours to not disturb or interfere with the comfort or convenience of occupants of any other condominium. Remodeling work is prohibited on Sundays and legal holidays.
- Falling Snow- The HOA is not responsible for any damage to persons or property from falling snow, ice or debris.
- Renters- Renter occupancy per condominium is limited to one person per pillow in designated sleeping areas only.
- Dress- Occupants of each condominium must be dressed appropriately for a public environment when within the hallways, lobby or other common areas of the building and the exercise room.
- Common Area Conditions- No bicycles, skis, exercise equipment, barbecues (other than gas grills), toys or other personal articles shall be allowed to stand in or on any balconies, decks, patios or on any of the common areas. All such areas shall be always kept in a neat and sanitary condition.
- Common Area Damage- Any damage to the Common Areas caused by an Owner, guest(s) or residential renter shall be repaired at the expense of such individual(s).
- Parking- Maximum parking spaces is 1 vehicle per condo. Parking in the garage area is restricted to condominium owners, their guests. All others will be towed at their expense. Long term parked vehicles shall be kept on record with the management company.
- Pets- No animals or birds, other than two (2) recognized house pets, shall be kept or maintained on any portion of the Property and then only if they are kept or maintained solely as domestic pets. No animal or bird shall be allowed to make an unreasonable amount of noise, or to become a nuisance. Pets shall be under leash when walked or exercised in the Common Areas and Facilities. Owners must immediately clean-up pet feces and discard appropriately.
- Nothing shall be hung from the balconies, decks, patios, railings, windows, or windowsills. No awnings, window guards, light reflective materials, shutters, ventilators, fans or air conditioning devices or other machinery or equipment shall be placed in such a location so as to be visible from the exterior of any condominium except as shall have been previously approved in writing by the Board of Trustees.
- No sign, notice or advertisement shall be inscribed, hung or exposed in any portion of the common areas or on the balconies, decks, patios, railings or windows of each condominium except as previously approved in writing by the Board of Trustees, which consent may be withheld on purely aesthetic grounds.
- No aerials, receivers or antennas of any kind shall be attached to, or hung from the exterior of a condominium or attached or hung from the balconies, decks, patios, railings and windows of a condominium.
- The exterior of the condominiums including balconies, decks, patios and railings shall not be painted, decorated or modified by any condominium owner and their families, guests or renters without prior written consent of the Board of Trustees which consent may be withheld on purely aesthetic grounds within the sole discretion of the Board of Trustees.
- Keys- Sterling Lodge’s property management company and its representative employee(s) shall retain a pass key to each condominium. No Owner shall alter any lock or install a new lock on any door leading into a condominium without providing a new key for the use by the HOA property management company for Sterling Lodge.
- Garbage- All garbage and refuse shall be deposited into the dumpster. No trash shall be placed or accumulated outside the dumpster area. Hot embers from fireplaces are prohibited from being placed in the dumpster.
- Ski Lockers- Ski lockers are owned by the condominium owners. Use of any locker is specifically limited to individual condominium owner approval. One locker per unit please.
- Entry door hardware/electronic locks – The entry door hardware cannot be changed/altered unless approved by the board in writing. The Schlage Encode Smart Wi-Fi Deadbolt with Century Trim in a finish that matches the existing Rocky Mt. hardware is the only approve electronic lock. Call Paul at PC LOCK for details.
- Hot Water Heaters- Unit owners are responsible for damage to common area and other units caused by their unit’s plumbing failure per Utah law. Owners are encouraged to replace hot water heaters every 5-9 years or according to manufactures specifications. In addition to water heaters, plumbing parts should be inspected on an annual basis.
- Electronic notice- The board or the management company may provide notice or communications to owners by electronic means, such as by email, text or by posting on the association’s website.
- Exercise Room- The exercise room on level one (1) may be used by owners and their guests only. Children under the age of 16 are not permitted unless supervised by an adult. Each unit is provided one (1) key to the room, replacement keys are $49. Please clean the machines after use. Do not tamper with TV electronics or controls. Please lock the door upon departure.
- Owners are responsible for the maintenance, repair, and replacement of conduits, ducts, vents, plumbing, air conditioning lines, utility lines (such as power, natural gas, water, sewer, telecommunications, cable, and any other future utility lines) that serve the Owner's Unit (unit specific) from the point of main line connection within the building. Fire sprinkler system excluded except in the case of owner negligence.
- Interior remodeling (including redecorating and any unit upgrades)-
- Remodeling from December 1 thru April 1 is prohibited
- Prior to remodeling, the Owner MUST notify the Board or Management
- Owner must complete Application for Improvement (below) and Contractor Checklist
- Owner must provide a construction security/damage deposit payable to the Sterling Lodge Owners Association - $5k for projects up to $10k and $10k for projects over $10k.
- Owner will be responsible for their contractors to complete DAILY common area cleaning and damage repairs.
- Common area floors, walls, elevators, etc. subject to worker traffic and materials, must be protected from dirt, dust, debris, damage and wear & tear.
- Elevator wall protective foam boards must be installed by the responsible party with Blue Scotch tape or equivalent.
- Common area furniture damage or theft resulting from the job will be charged to the Owner.
- The common area dumpster cannot be used for construction debris or furniture shipping containers.
- All debris must be removed from the property.
- Owners not in compliance will be subject fine deductions from security deposit
The foregoing Rules and Regulations for owners and their families, guests and residential renters are subject to amendment and to the promulgation of further regulations.
